EVENT PLATFORM SYSTEMS

In aceasta pagina sunt prezentati termenii si conditiile aplicabile cumparatorilor de Bilete prin intermediul platformei Event Platform Systems.

Termenii si conditiile prezentate in continuare sunt in vigoare incepand cu data de 23.03.2026.

Serviciile furnizate prin intermediul platformei Event Platform Systems se adreseaza doar persoanelor fizice majore avand cel putin 18 ani impliniti si capacitate de exercitiu deplina, precum si intreprinderilor, indiferent de forma juridica. Utilizatorul persoana fizica declara si garanteaza ca are cel putin 18 ani, prin simpla acceptare a prezentului acord. Fiecare utilizator declara si garanteaza ca potrivit prevederilor legale aplicabile are dreptul sa utilizeze serviciile noastre si sa acceseze platforma Event Platform Systems si isi asuma intreaga raspundere pentru alegerea si utilizarea serviciilor noastre. Varsta participantilor la Evenimente este stabilita prin Termenii si Conditiile Organizatorului, modalitatea de participare efectiva fiind in sarcina acestuia.

1. Elemente definitorii

1.1. Platforma Event Platform Systems este administrata si detinuta prin intermediul site-ului https://event-platform-systems.ro (denumit in continuare „platforma EPS”) de catre societatea EVENT PLATFORM SYSTEMS S.R.L., cu sediul social in Bucuresti Sectorul 1, Strada Nicolae G. Caranfil, Nr. 69, Etaj 2, cod unic de inregistrare 54062665, nr. de inregistrare la Registrul Comertului J2026012420003, EUID: ROONRC.J2026012420003.

1.2. Platforma Event Platform Systems este o platforma de ticketing online, oferind utilizatorilor servicii de intermediere independente in achizitia de Bilete pentru diverse evenimente.

1.3. Termenii si Conditiile reprezinta contractul incheiat de dumneavoastra cu Operatorul de Servicii Ticketing, va rugam sa cititi integral acest document inainte de a utiliza serviciile furnizate de societatea noastra.

1.4. In cuprinsul acestui document urmatorii termeni vor insemna:

  • „Operatorul de Servicii Ticketing”: EVENT PLATFORM SYSTEMS S.R.L., cu sediul social in Bucuresti Sectorul 1, Strada Nicolae G. Caranfil, Nr. 69, Etaj 2, cod unic de inregistrare 54062665, nr. de inregistrare la Registrul Comertului J2026012420003, EUID: ROONRC.J2026012420003;
  • „Organizator”: persoana fizica sau juridica care actioneaza in calitate de profesionist, care ofera Bilete la evenimentele afisate pe Site consumatorilor, ce urmeaza a fi vandute prin intermediul platformei EPS, in scopuri legate de activitatea sa comerciala, de afaceri, mestesugareasca sau profesionala;
  • „Site”: website-ul Organizatorului si aplicatiile pentru mobil distribuite prin platformele GooglePlay (versiunea Android) si AppStore (versiunea iOS), in cazul in care acestea exista, de unde poate fi analizata oferta de Bilete disponibile, a caror achizitie va fi intermediata de Operatorul de Servicii Ticketing;
  • „Utilizator”: orice persoana care acceseaza Site-ul sau care utilizeaza in orice modalitate orice serviciu furnizat prin intermediul platformei EPS;
  • „Cumparator”: persoana fizica sau juridica sau alta entitate juridica care acceseaza Site-ul si plaseaza o Comanda;
  • „Bilete”: orice Bilet la evenimentul prezentat pe Site, inclusiv cele mentionate in Comanda sau privitoare la felul in care acestea urmeaza a fi furnizate Cumparatorului;
  • „Serviciu”: orice serviciu de intermediere furnizat de Organizatorul Servicii Ticketing;
  • „Comanda”: documentul electronic ce intervine ca forma de comunicare intre Organizator si Cumparator, respectiv intre Operatorul de Servicii Ticketing si Cumparator, prin care Organizatorul este de acord sa livreze Cumparatorului Bilete, respectiv Operatorul de Servicii Ticketing este de acord sa livreze Cumparatorului Serviciile de intermediere, iar Cumparatorul este de acord sa primeasca aceste Bilete si Servicii si sa efectueze plata acestora;
  • „Contract”: Comanda confirmata de catre Organizator. Incheierea Contractului nu are loc la plasarea Comenzii.

1.5. Prin accesarea si utilizarea Site-ului, achizitionarea unui Bilet prin platforma EPS, si/sau utilizarea Serviciilor, va exprimati acceptul in totalitate si in mod neconditionat fata de dispozitiile prezentului document, precum si fata de Politica de confidentialitate si Politica de utilizare a cookie-urilor, care fac parte integranta din acesta, si va obligati sa le verificati periodic. Va recomandam sa cititi cu atentie aceste documente.

2. Modificarea termenilor de utilizare a Serviciilor

2.1. Operatorul de Servicii Ticketing isi rezerva dreptul de a modifica oricand Termenii si Conditiile, fara o notificare in prealabil sau fara precizarea motivelor.

2.2. Modificarile vor fi realizate prin actualizarea acestui document, devenind obligatorii si cu efect imediat.

2.3. In cazul in care nu sunteti de acord cu modificarile realizate, va rugam sa incetati accesarea si utilizarea Serviciilor si sa nu achizitionati Bilete prin platforma EPS.

2.4. Continuarea accesarii si utilizarii platformei EPS sau achizitionarea Biletelor prezentate pe Site sau a Serviciilor de catre dumneavoastra dupa modificarea prezentului document va constitui acceptarea modificarilor realizate.

3. Obiectul prezentilor termeni si conditii

3.1. Prezentul document contine termenii si conditiile aplicabile cumparatorilor de Bilet si stabileste care sunt conditiile in care orice persoana poate accesa platforma EPS, poate achizitiona Biletele afisate pe Site, ori poate utiliza in orice mod Serviciile oferite prin intermediul platformei EPS.

4. Documente contractuale

4.1. In momentul plasarii unei Comenzi, Cumparatorul isi exprima acordul pentru a primi din partea Operatorului de Servicii Ticketing / Organizatorilor mesaje comerciale electronice si / sau prin intermediul telefonului prin bifarea casutei prin care declara ca este de acord cu transmiterea datelor de contact Organizatorului si Operatorului de Servicii Ticketing.

4.2. Comenzile efectuate pe Site sunt confirmate printr-un e-mail de inregistrare primit dupa finalizarea respectivelor Comenzi.

4.3. Concomitent cu achizitia online de Bilete, Operatorul de Servicii Ticketing va comunica si individualizeaza pretul aferent Serviciilor de intermediere prestate separat de pretul Biletelor procurate.

4.4. Dupa redirectionarea catre procesatorul de plata, utilizatorii au la dispozitie maxim 10 minute pentru a plati comanda, altfel aceasta va expira, iar locurile selectate pot fi ocupate intre timp de catre alt Utilizator.

4.5. In urma finalizarii cu succes a unei Comenzi, Cumparatorul primeste pe adresa de e-mail furnizata direct din partea Organizatorului evenimentului respectiv fie Biletele Comandate, fie instructiuni suplimentare necesar a fi indeplinite pentru revendicarea Biletului. In cazul unora dintre evenimentele pentru care achizitia de Bilete este intermediata de platforma EPS, Organizatorul poate sa opteze pentru pasi suplimentari necesari a fi urmati de Cumparator fie pentru revendicarea Biletului, fie pentru a primi acces in cadrul evenimentului.

4.6. In toate cazurile, pentru achizitia de Bilete este necesara acceptarea prezentilor Termeni si Conditii, Politicilor de confidentialitate, Politicii de utilizare a cookie-urilor, precum si a Regulamentului Oficial al Evenimentului transmis de Organizator.

4.7. Accesul la evenimentul pentru care s-au achizitionat Biletele obiect al Comenzii se face in baza scanarii codului QR de pe Bilet, ulterior revendicarii Biletului. Codurile QR sunt unice, Biletele fiind nominale si netransmisibile si fiecare permite accesul unei singure persoane la eveniment.

4.8. Pentru revendicarea finala a Biletelor, acestea trebuie personalizate. Astfel, persoana ce va putea scana codul QR este persoana mentionata pe Bilet, identitatea acesteia urmand a fi verificata conform Regulamentului Oficial al Evenimentului. Nicio alta persoana nu va putea scana codul QR, iar odata scanat un cod QR, o alta persoana nu mai poate intra cu acesta.

4.9. La momentul transmiterii Biletului la adresa de e-mail indicata de Cumparator, sub conditia indeplinirii de catre Cumparator a tuturor conditiilor mentionate in prezentii Termeni si Conditii, precum si in Regulamentul Oficial al Evenimentului, acesta se considera livrat si obligatia Operatorului de Servicii Ticketing indeplinita.

4.10. Din considerente de securitate si pentru prevenirea utilizarii multiple si/sau frauduloase, ulterior livrarii: (a) Biletul nu mai poate fi modificat (inclusiv, dar fara a se limita la tipul Biletului, categoria, intervalul sau sesiunea, dupa caz); si (b) codul QR asociat Biletului nu poate fi regenerat, reemis, inlocuit sau retransmis sub forma unui cod nou, indiferent de motiv, inclusiv in caz de pierdere, stergere, redirectionare, divulgare si/sau acces neautorizat la adresa de e-mail a Utilizatorului.

4.11. Cumparatorul are obligatia de a asigura confidentialitatea si securitatea accesului la propria sa adresa de e-mail, la contul sau deschis pe Site si la dispozitivul pe care este stocat Biletul, precum si de a nu transmite codul QR catre terti. Operatorul de Servicii Ticketing nu raspunde pentru utilizarea neautorizata a Biletului ca urmare a compromiterii credentialelor Utilizatorului si/sau a divulgarii codului QR catre terti, cu exceptia situatiilor in care legea impune altfel ori in care incidentul este cauzat de culpa exclusiva a Operatorului de Servicii Ticketing.

5. Drepturi de proprietate intelectuala

5.1. Intregul continut al platformei EPS este proprietatea Operatorului de Servicii Ticketing si este protejat de legea dreptului de autor, neputand fi preluat, copiat partial sau integral sau folosit pentru crearea de opere derivate fara acordul expres scris in prealabil al proprietarului. Folosirea in alt scop decat cel personal sau non-comercial este strict interzisa.

5.2. In cazul in care considerati ca un anumit continut aflat pe Site/ platforma EPS incalca drepturile dumneavoastra de proprietate intelectuala, dreptul la viata privata, la publicitate sau alte drepturi personale, sunteti rugat sa trimiteti un e-mail la adresa de e-mail [email protected] cu drepturile incalcate, pentru a permite Organizatorului sau Operatorului de Servicii Ticketing, dupa caz, sa actioneze in conformitate pentru analiza solicitarii si inlaturarea acestor aspecte.

5.3. Utilizarea oricaror informatii de pe platforma EPS in alte scopuri decat cel consultativ, in special in scopuri publice, comerciale sau umoristice, poate face obiectul unor demersuri judiciare.

6. Conduita interzisa

6.1. Este strict interzis:

  • copierea partiala sau totala, dezasamblarea, crearea de opere derivate sau folosirea in oricare alta modalitate a codului sursa a platformei EPS, precum si a oricarui element continut in Serviciile platformei EPS, inclusiv, dar fara a se limita la: texte, imagini, tabele, specificatii, forma de prezentare sau continut de orice alta natura;
  • utilizarea Serviciilor platformei EPS in alte scopuri decat pentru uz personal, individual si in scopuri nepersonale;
  • vanzarea, inchirierea, distributia, transmiterea sau acordarea de drepturi unei terte persoane privind Serviciile platformei EPS sau a contului creat de catre dumneavoastra pentru utilizarea acestora;
  • folosirea Serviciilor platformei EPS pentru a invada intimitatea tertilor, pentru a obtine informatii despre oricare dintre utilizatorii acestor Servicii, pentru a obtine o lista de utilizatori ai acestor Servicii, sau pentru folosirea tehnologiilor de data mining, roboti sau alte sisteme similare de colectare a datelor;
  • copierea, modificarea, stergerea sau deterioarea oricarei informatii continute pe echipamentele tehnice, incluzand, dar fara a se limita la serverele si calculatoarele utilizate sau controlate de catre Operatorului de Servicii Ticketing;
  • asumarea unei identitati false sau pretinderea unei afilieri inexistente.

6.2. Ca urmare a incalcarii oricarei interdictii prevazute in prezentul document, Operatorului de Servicii Ticketing are dreptul sa blocheze cu efect imediat, temporar sau permanent, accesul la contul implicat in activitatea interzisa, fara ca acest lucru sa limiteze dreptul Operatorului de Servicii Ticketing de a apela la caile legale pentru a obtine repararea eventualelor prejudicii cauzate de activitatea desfasurata prin intermediul contului dumneavoastra.

7. Drepturile si obligatiile partilor contractante

7.1. Prezentele conditii generale de vanzare stabilesc conditiile contractuale aplicabile Biletelor achizitionate prin intermediul platformei EPS.

7.2. Prin acceptarea prezentelor prevederi din Termeni si Conditii, Utilizatorul si/sau Cumparatorul este de acord cu urmatoarele:

  • in cazul in care Utilizatorul/ Cumparatorul este o persoana fizica, actioneaza in nume propriu si nu reprezinta nicio alta persoana;
  • daca Utilizatorul/Cumparatorul este reprezentantul unei persoane juridice, acesta declara ca actioneaza in limitele imputernicirii ce i-a fost acordata;
  • Cumparatorul va furniza informatii reale, corecte si complete in vederea utilizarii platformei EPS;
  • Utilizatorul/ Cumparatorul nu va utiliza platforma EPS pentru a reproduce, duplica, copia, vinde, revinde, distribui, publica sau exploata, in niciun scop comercial, software-ul, continutul, ofertele sau Serviciile furnizate de catre Operatorul de Servicii Ticketing, Organizatori sau parteneri sau obtinute prin intermediul platformei EPS fara sa obtina consimtamantul expres, prealabil si scris al Operatorului de Servicii Ticketing. Aceasta restrictie include orice incercare de a incorpora orice informatie de pe platforma EPS/ Site in orice alt catalog, produs sau serviciu;
  • Utilizatorul/ Cumparatorul nu va utiliza platforma EPS/Site-ul in niciun mod care ar putea sa afecteze in mod negativ disponibilitatea resurselor sale sau utilizarea sa de catre alti Utilizatori / Cumparatori sau in orice mod care ar putea defecta, dezactiva, supraincarca sau deteriora serverele sau retelele Operatorului de Servicii Ticketing sau ale unor terte persoane;
  • Utilizatorul/Cumparatorul nu va utiliza platforma EPS/Site-ul in orice scop care este ilegal sau interzis prin acesti Termeni si Conditii sau prin alte politici relevante.

7.3. Operatorul de Servicii Ticketing, in baza obligatiilor de informare pentru contractele la distanta, inainte de a contracta la distanta, va informam prin intermediul Site-ului despre:

  • identitatea companiei, adresa postala la care Operatorul de Servicii Ticketing este stabilit precum si adresa de posta electronica sau numarul de telefon la care putem fi efectiv contactati, pentru a-i permite Utilizatorului/Cumparatorului sa ia rapid legatura cu Operatorul de Servicii Ticketing si sa comunice cu aceasta in mod eficient si, daca este cazul, adresa postala si identitatea profesionistului in numele caruia actioneaza;
  • principalele caracteristici ale Serviciilor oferite de Operatorul de Servicii Ticketing, avand in vedere mediul de comunicare si produsele in cauza;
  • pretul total al Biletelor si Serviciilor cu toate taxele incluse sau, exceptional, in cazul in care pretul nu poate fi calculat dinainte in mod rezonabil, modalitatea de calcul al pretului si, dupa caz, toate costurile suplimentare de orice natura sau, in cazul in care acestea nu pot fi calculate anticipat in mod rezonabil, mentionarea faptului ca aceste costuri suplimentare ar putea fi suportate de Cumparator, inclusiv perioada de valabilitate a ofertei sau a preturilor;
  • durata contractului, dupa caz, sau, daca contractul urmeaza sa fie prelungit in mod automat, conditiile de incetare a contractului;
  • durata minima de valabilitate a obligatiilor care ii revin Cumparatorului conform contractului.

8. Inregistrarea pe Site

8.1. Accesul la Bilete vandute de Organzatori si Serviciile puse la dispoztie de Operatorul de Servicii Ticketing se poate face online, de pe computerul personal sau de pe un dispozitiv mobil, de tipul tableta sau telefon, prin crearea unui cont pe Site.

8.2. Utilizarea Site-ului necesita activarea cookies pentru browserul folosit de dumneavoastra. Browserele recomandate pentru accesarea si utilizarea Site-ului sunt cele mentionate in Termenii si Conditiile Organizatorului.

8.3. Pentru a crea un cont este nevoie sa furnizati o adresa de e-mail personala, care va fi asociata contului dumneavoastra de pe Site. Organizatorul va transmite in mod automat aceste date catre Operatorul de Servicii Ticketing, si prin intermediul acestei adrese de e-mail se va desfasura ulterior comunicarea cu reprezentantii Operatorului de Servicii Ticketing.

8.4. Suplimentar, Organizatorul poate stabili pasi suplimentari pentru inregistrarea pe Site, conform propriilor Termeni si Conditii.

8.5. Prin crearea contului pe Site declarati ca datele furnizate de catre dumneavoastra prin intermediul formularului de inregistrare sunt corecte si complete, si acceptati ca sunteti raspunzator pentru activitatea desfasurata prin intermediul contului dumneavoastra.

8.6. Contul creat pe Site este personal, fiind interzisa utilizarea datelor de acces sau a contului altei persoane, fie temporar sau permanent. In cazul in care astfel de date au fost introduse din culpa si nu pot fi remediate sau corectate in mod direct de catre dumneavoastra, sunteti obligat sa aduceti de indata la cunostinta acest aspect Organizatorului in vederea efectuarii cuvenitelor rectificari, sub sanctiunea suspendarii si/sau restrictionarii temporare sau definitive a contului dvs. si chiar si a accesului pe Site. De asemenea, va obligati sa contactati de indata reprezentantii Organizatorul in cazul in care securitatea contului dumneavoastra a fost compromisa. Operatorul de Servicii Ticketing nu poate actiona in niciun mod asupra Site-ului, nefiind detinut de Operatorul de Servicii Ticketing, ci de Organizator, fiind astfel absolvit de orice responsabilitate.

8.7. Prin acceptarea prezentilor Termeni si Conditii, va exprimati in mod expres acordul pentru utilizarea numarului de telefon ori a adresei de posta electronica (e-mail), necesare comunicarilor ce urmeaza a fi transmise de catre Operatorul de Servicii Ticketing. Aceste informatii sunt transmise catre Operatorul de Servicii Ticketing de catre Organizator in vederea prestarii Serviciilor.

8.8. Prin inregistrarea pe Site, veti accepta atat Termenii si Conditiile Organizatorului, cat si Termenii si Conditiile Operatorului de Servicii Ticketing. Prin selectarea acestor optiuni si apasarea butoanelor de plasare a comenzii/ continuare la plata, in conform Termenilor si Conditiilor Organizatorului, indica faptul ca sunteti de acord cu respectarea termenilor si conditiilor pe care le-ati citit, le-ati inteles si le-ati acceptat in integralitate.

9. Plasarea unei Comenzi

9.1. Accesand Site-ul si folosind meniul dedicat, puteti naviga printre evenimentele disponibile si, de acolo, pe pagina individuala a fiecarui eveniment, unde veti vedea informatii detaliate cu privire la respectivul eveniment. Mentionam ca interfata de selectie este gazduita direct pe Site-ul Organizatorului.

9.2. Dupa identificarea evenimentului dorit, veti selecta numarul de Bilete din dreptul categoriei preferate, in limita locurilor disponibile afisate in timp real prin sistemul tehnic de gestionare a Biletelor integrat in Site. Instructiunile exacte cu privire la pasii pentru plasarea Comenzilor le veti gasi pe Site-ul Organizatorului.

9.3. Biletele nu vor fi livrate fizic, ci doar online. Biletele vor fi livrate de Organizator. Operatorul de Servicii Ticketing gestioneaza Comenzile plasate, centralizeaza aceste Comenzi si intermediaza Serviciul de ticketing, transmitand Organizatorului detaliile necesare pentru livrarea Biletelor.

9.4. Dupa efectuarea platii Biletelor, veti fi redirectionat catre o noua pagina pe Site-ul Organizatorului unde este necesar sa transmiteti datele dumneavoastra personale in vederea personalizarii Biletelor achizitionate. Numai Cumparatorul va putea personaliza toate Biletele achizitionate.

9.5. In cazul in care Biletele nu sunt personalizate imediat dupa plata Comenzii, va punem in vedere ca aveti un termen de 7 zile in vederea personalizarii acestora. Astfel, platforma EPS va transmite un e-mail catre dumneavoastra prin care va pune in vedere sa efectuati acest pas si va transmite un link pe care il veti putea utiliza in acest sens.

9.6. In cazul in care nu veti personaliza Biletele in termenul de 7 zile anterior mentionat, incepand cu ziua a 8-a va rugam sa aveti in vedere ca pentru personalizarea Biletelor va fi necesara achitarea unei taxe in valoare de 75 de lei.

9.7. Urmare a personalizarii Biletelor, acestea vor fi transmise catre dumneavoastra prin adresa de e-mail furnizata de dumneavoastra la momentul plasarii comenzii. In vederea accesului efectiv in cadrul evenimentului, va rugam sa analizati cu atentie Regulamentul Oficial al Evenimentului.

9.8. In cazul in care nu veti personaliza Biletele pana la momentul accesului in cadrul evenimentului, va rugam sa aveti in vedere faptul ca accesul la eveniment nu va va fi permis. In acest caz, nu veti putea recupera nici costul Biletului, nici costul Serviciului prestat de Operatorul de Servicii Ticketing, Serviciile prestate de acesta fiind efectuate in integralitate, iar responsabilitatea personalizarii Biletelor este a Cumparatorului si nu a Organizatorului sau a Operatorului de Servicii Ticketing. Prin urmare, va recomandam personalizarea Biletelor imediat ce plasati comanda.

10. Plata

10.1. Toate preturile afisate in cadrul Site-ului sunt in LEI si includ TVA (cota 21%). Preturile afisate nu includ cheltuielile de livrare.

10.2. In conformitate cu Ordonanta de urgenta nr. 34/2014 privind drepturile consumatorilor in cadrul contractelor incheiate cu profesionistii, precum si pentru modificarea si completarea unor acte normative, Operatorul de Servicii Ticketing se angajeaza sa aduca la cunostinta Cumparatorului modalitatile de plata pentru Biletele achizitionate.

10.3. Cumparatorul are cunostinta de faptul ca in momentul in care face comanda pentru Bilete, aceasta comanda implica obligatia de a plati.

10.4. Operatorul de Servicii Ticketing nu stabileste pretul Biletelor, ci doar pretul Serviciilor, si isi rezerva dreptul de a modifica preturile aplicabile Serviciilor in orice moment, fara nicio notificare in prealabil si fara motivare.

10.5. Va informam ca faptul Organizatorul isi rezerva de asemenea dreptul de a modifica pretul Biletelor, pentru mai multe detalii va rugam sa accesati Termenii si Conditiile Organizatorului.

10.6. Noile preturi vor fi aplicabile numai Biletelor si Serviciilor achizitionate dupa data modificarii preturilor. In cazul in care nu sunteti de acord cu modificarile preturilor, aveti optiunea de a inceta utilizarea Serviciilor.

10.7. Toate problemele legate de plati vor fi gestionate in totalitate de catre reprezentantii Operatorul de Servicii Ticketing. In cazul unor nelamuriri, va rugam sa trimiteti un e-mail la adresa [email protected].

11. Modalitati de plata

Pentru cumpararea de Bilete, vor fi acceptate urmatoarele modalitati de plata:

11.1. Plata cu cardul

11.1.1. Platile prin intermediul cardurilor de debit sau credit sunt procesate de catre BT iPay. Comunicatia cu procesatorul de plati se face prin intermediul unei conexiuni securizate SSL, datele transmise fiind criptate. Toate informatiile privind cardul vor fi prelucrate exclusiv de catre procesatorul de plati.

11.1.2. Prin mentinerea activa a optiunii „Activeaza optiunea plati rapide”, prezenta in formularul de plata online pus la dispozitia Operatorului de Servicii Ticketing de catre procesatorul de plati, utilizatorul isi da acceptul pentru activarea serviciului prin care se vor putea efectua ulterior plati online doar prin introducerea codului de securitate CVC2/CVV.

11.1.3. La platile cu cardul se adauga si taxa de operare platforma online pentru comenzi achitate cu cardul. Suma efectiva de plata va fi afisata inainte de a fi directionat catre pagina procesatorului de plati.

11.2. Plata prin transfer bancar

11.2.1. Este necesara formularea unei solicitari scrise pe adresa de e-mail [email protected] pentru transmiterea datelor bancare.

12. Facturarea

12.1. Fiecare Comanda confirmata include tipul Biletelor si Serviciile, preturile, modalitatea si termenul de plata.

12.2. In cazul in care clientul doreste emiterea facturii aferente Comenzii, se pot emite facturi fiscale in urma unei solicitari scrise primite printr-un mail catre [email protected].

12.3. Solicitarea trebuie sa contina toate datele complete si corecte: numarul de comanda sau numele pe care s-a efectuat comanda si datele de facturare complete (nume, CUI/CNP, nr. reg comert, sediu social/ docmiciliu, cont bancar, banca la care este deschis contul, delegat).

12.4. Factura pentru pretul Biletului nu este emisa de Operatorul de Servicii Ticketing, ci de catre Organizatorul evenimentului in numele caruia vindem Bilete. Cererea ta ajunge pe e-mail direct la Organizator.

12.5. Daca pretul aferent Serviciilor de intermediere este incasat de la Cumparator, atunci factura pentru acesta nu este emisa de catre Organizatorul evenimentului ci de catre Operatorul de Servicii Ticketing, clientul urmand a primi astfel doua facturi: cea eliberata de Organizator reprezentand pretul Biletului, precum si cea eliberata de Operatorul de Servicii Ticketing, reprezentand Serviciile.

13. Dreptul de retragere

13.1. Achizitionarea de servicii privind activitatile de agrement, in cazul in care este prevazuta o data de executare specifica, este exceptata de la aplicarea dreptului de retragere reglementat de OUG 34/2014, in conformitate cu art. 16 lit. l) din actul normativ anterior mentionat.

13.2. Activitatile de agrement reprezinta totalitatea mijloacelor, evenimentelor si formelor de petrecere a timpului liber, menite sa asigure recreere, relaxare, buna dispozitie si satisfactie.

13.3. Totodata, contractele de prestari de servicii sunt exceptate de la dreptul de retragere, dupa prestarea completa a serviciilor, daca executarea a inceput cu acordul prealabil expres al consumatorului si dupa ce acesta a confirmat ca a luat cunostinta de faptul ca isi va pierde dreptul la retragere dupa executarea completa a contractului de catre profesionist, in conformitate cu art. 16 lit. a) din OUG 34/2014.

13.4. Prin urmare, nu veti putea solicita returnarea contravalorii Biletelor achizitionate prin exercitarea dreptului de retragere, cu exceptiile prevazute in sectiunea 15.

13.5. Serviciile de intermediere (inclusiv de emitere Bilet), de operare platforma online si cele conexe acestora furnizate de Operatorul de Servicii Ticketing prin intermediul platformei EPS sunt exceptate de la dreptul de retragere. Cumparatorul de Bilet este expres de acord cu inceperea executarii Serviciilor de intermediere, de emitere Bilet si Serviciile conexe acestora de la finalizarea Comenzii. Cumparatorul de Bilet declara ca intelege ca prin finalizarea comenzii isi va pierde dreptul de retragere, ca urmare a executarii complete a contractului de catre Operatorul de Servicii Ticketing.

14. Achizitia de Bilete prin intermediul platformei EPS, integrate in site-ul Organizatorului

14.1. Organizatorii vor comercializa Bilete direct prin intermediul Site-urilor proprii, utilizand Serviciile sau alte solutii tehnice furnizate de Operatorul de Servicii Ticketing.

14.2. In toate aceste cazuri, Utilizatorul intelege si accepta ca (a) aceste Site-uri sunt in afara controlului Operatorul de Servicii Ticketing si (b) ii sunt aplicabile in egala masura termenii si conditiile de utilizare a Site-ului respectiv.

14.3. Fara a aduce atingere celor de mai sus, precizam ca Organizatorii pot implementa si utiliza in aceste Site-uri diverse tool-uri, inclusiv de masurare a performantei reclamelor ori de monitorizare a modului in care utilizatorii interactioneaza cu Site-ul Organizatorului, pentru a maximiza conversiile din campaniile platite pe care le desfasoara, dar fara a se limita la acestea (precum pixels, trackers, Google Analytics). Utilizarea acestor tool-uri in Site-urile organizatorilor se face pe propria raspundere a acestora.

15. Returnarea contravalorii Biletelor

15.1. Operatorul de Servicii Ticketing va putea returna in caz de anulare a comenzii doar pretul Biletului, nu si pretul Serviciilor de intermediere aferente achizitiei facute (inclusiv pretul de emitere Bilet), taxa de operare platforma online si Serviciile conexe acestora odata cu finalizarea comenzii.

15.2. In cazul anularii evenimentului de catre Organizator, Organizatorul va putea returna doar pretul Biletului, nu si pretul Serviciilor de intermediere aferente achizitiei facute (inclusiv pretul de emitere Bilet), taxa de operare platforma online si Serviciile conexe acestora odata cu finalizarea comenzii. Pentru claritate, Operatorul de Servicii Ticketing nu va returna pretul si costul Serviciilor de intermediere aferente achizitiei facute, inclusiv pretul de emitere Bilet, acestea fiind nerambursabile din perspectiva Operatorul de Servicii Ticketing.

15.3. Anularea comenzilor si returnarea contravalorii Biletelor se poate face, daca Organizatorul permite acest lucru, printr-un mail la [email protected].

15.4. In caz ca optati pentru returnarea contravalorii Biletelor in cont bancar, va rugam sa ne oferiti un IBAN din Romania (RO .. ) sau un cont de Paypal. Organizatorul nu va returna contravaloarea Biletelor in conturi inregistrate la banci din alte tari sau in conturi de Revolut.

15.5. Prin anularea Biletelor se vor anula toate Biletele dintr-o comanda. Nu puteti anula doar o parte din Bilete.

15.6. Pentru majoritatea evenimentelor, Organizatorul este liber sa nu permita renuntarea la Bilet. Renuntarea la Bilet se poate face cu titlu exceptional. Achizitionarea de Biletele la spectacole este exceptata de la aplicarea dreptului de retragere reglementat de OUG 34/2014, in conformitate cu art. 16 lit. l) din actul normativ mentionat mai sus.

15.7. Anumiti Organizatori de evenimente au ales ca, in caz de anulare a unui eveniment, sa returneze contravaloarea Biletelor prin intermediul Operatorul de Servicii Ticketing sau printr-o alta agentie de ticketing, dupa 14 zile calendaristice de la data anuntului de anulare. In cazul nefericit al anularii unui astfel de eveniment, veti fi informati pe e-mail iar banii se vor returna conform politicilor Organizatorului evenimentului.

15.8. Pentru anumite evenimente de pe Site, pretul Serviciilor de intermediere (indiferent de natura acestora) este inclus in pretul afisat al Biletului, insa acest lucru va fi specificat in mod explicit si cu titlu de exceptie.

15.9. Biletul achizitionat poate fi returnat sau schimbat numai daca Organizatorul accepta si numai cu respectarea conditiilor din prezentul capitol, cu exceptia cazului in care evenimentul respectiv este anulat (nu mai are loc), caz in care returnarea Biletului si rambursarea sumelor achitate va fi efectuata potrivit procedurii din prezentul capitol. Sub nicio forma nu se mai iau in considerare cererile de rambursare primite in data de desfasurare a evenimentului (sau in prima zi a acestuia, in cazul unui festival).

15.10. Returnarea Biletului poate fi efectuata in termenele si cu respectarea conditiilor de mai jos, prin transmiterea unei solicitari in acest sens catre [email protected]:

15.10.1. In cazul in care solicitarea de returnare este formulata cu mai mult de 14 zile inainte de data de desfasurare a evenimentului (sau de prima zi a acestuia, in cazul unui festival), Cumparatorul de Bilet primeste ca urmare a anularii Biletului doar suma platita cu titlu de pret al Biletului (fara alte taxe, tarife, costuri, cheltuieli suportate de cumparator cu ocazia cumpararii acestuia, inclusiv, dar fara a se limita la tarif curier, taxa de rezervare, costuri intermediere, emitere Bilet etc.) sau un voucher echivalent acestei sume, care poate fi utilizat pentru cumpararea de Bilete la alte evenimente prin intermediul Site-ului;

15.10.2. In cazul in care solicitarea de returnare este formulata cu cel putin 7 zile (dar cel mult 14) inainte de data de desfasurare a evenimentului (sau de prima zi a acestuia, in cazul unui festival), Cumparatorul de Bilet primeste ca urmare a anularii Biletului, fie 70% din suma platita cu titlu de pret al Biletului (fara alte taxe, tarife, costuri, cheltuieli suportate de cumparator cu ocazia cumpararii acestuia, inclusiv, dar fara a se limita la tarif curier, taxa de rezervare, daca e cazul etc.), fie un voucher echivalent acestei sume, care poate fi utilizat pentru cumpararea de Bilete la alte evenimente prin intermediul Site-ului.

15.10.3. In cazul in care solicitarea de returnare este formulata cu cel putin o zi inainte (dar cel mult 7) de data de desfasurare a evenimentului (sau de prima zi a acestuia, in cazul unui festival), Cumparatorul de Bilet primeste ca urmare a anularii Biletului, fie 50% din suma platita cu titlu de pret al Biletului (fara alte taxe, tarife, costuri, cheltuieli suportate de cumparator cu ocazia cumpararii acestuia, inclusiv, dar fara a se limita la tarif curier, taxa de rezervare, daca e cazul etc.), fie un voucher echivalent acestei sume, care poate fi utilizat pentru cumpararea de Bilete la alte evenimente prin intermediul Site-ului.

15.10.4. In toate cazurile de mai sus, pretul Serviciilor furnizate de Operatorul de Servicii Ticketing nu se returneaza si nu se ia in calcul la determinarea valorii voucherului. Optiunea pentru voucher / returnare bani apartine cumparatorului de Bilet.

15.10.5. Optiunile enumerate la punctul 15.10 nu vor putea fi combinate sau cumulate.

15.11. In cazul reprogramarii evenimentului, Cumparatorul de Bilet poate solicita rambursarea contravalorii Biletelor achizitionate, numai daca Organizatorul accepta aceasta optiune. Cererea de rambursare trebuie formulata in termen de maximum 7 zile de la data comunicarii deciziei de reprogramare, iar rambursarea se va efectua prin una dintre metodele prevazute in prezentele Termeni si Conditii. Pretul Serviciilor de intermediere aferente achizitiei facute (inclusiv pretul de emitere Bilet), a taxei de operare platforma online si a pretului Serviciilor conexe, nu se vor returna.

15.12. In eventualitatea anularii unui eveniment, va rugam sa trimiteti solicitarea dvs. in acest sens pe adresa de e-mail [email protected], precum si catre adresa de contact a Organizatorului evenimentului anulat.

Operatorul de Servicii Ticketing va colabora cu Organizatorul evenimentului in cauza in vederea rambursarii sumelor achitate cu titlu de pret pentru Biletele achizitionate de dvs, dar nu ofera nicio garantie in acest sens si nu are nicio obligatie de a despagubi Cumparatorul de Bilet in lipsa unei intelegeri prealabile cu Organizatorul evenimentului.

15.13. Sub nicio forma Biletele nu se mai pot returna dupa ce evenimentul a avut loc.

15.14. Deciziile de reprogramare sau de anulare a evenimentelor, precum si alegerile intre reprogramare sau anulare sunt luate exclusiv de Organizatori, fara implicarea Operatorul de Servicii Ticketing.

16. Relocari

16.1. In cazul in care Organizatorul evenimentului permite, Operatorul de Servicii Ticketing poate efectua oricand relocari cu Biletele cumparate de dumneavoastra de pe locurile pe care le aveti pe alte locuri, cu informarea in prealabil a Cumparatorului si cu transmiterea prin e-mail a noilor locuri. Aceste relocari sunt motivate de masuri care tin de productia evenimentelor si pot aparea spontan chiar cu cateva zile sau chiar o zi inainte de eveniment. Locurile cumparate de dumneavoastra pot fi ocupate de echipamente tehnice sau de butaforii sau pot fi relocate la cerinta artistului interpret. Aceste cazuri sunt totusi foarte rare. In caz ca doriti returnarea contravalorii Biletelor daca ati fost relocat/a, puteti solicita acest lucru conform capitolului 15.

16.2. Relocarea automata a Cumparatorului de Bilet pe alte locuri decat cele selectate poate aparea si pe parcursul derularii procesului de achizitie a Biletelor, pana la finalizarea comenzii. Aceasta poate fi efectuata in mod automat de programul informatic care gestioneaza vanzarea de Bilete, ca urmare a cererii crescute si a accesarii concomitente a Site-ului de catre un numar mare de utilizatori. O astfel de masura poate fi consecinta unor circumstante obiective, precum supraincarcarea serverelor Operatorul de Servicii Ticketing ori ale procesatorilor de plati.

16.3. Operatorul de Servicii Ticketing nu isi asuma raspunderea pentru relocarile automate generate de astfel de situatii exceptionale si nu garanteaza indisponibilizarea locurilor selectate pentru perioada de timp in care Utilizatorul este in proces de a plati Comanda.

16.4. Prin achizitionarea de Bilete de pe Site prin intermediul platformei EPS, Utilizatorii isi asuma riscul relocarii pe alte locuri decat cele selectate, in situatia descrisa anterior. Utilizatorii nemultumiti de locurile realocate se pot adresa Operatorului de Servicii Ticketing, in termen de cel mult 3 zile de la achizitionarea Biletelor, dar in niciun caz in ziua desfasurarii evenimentului (sau in prima zi a acestuia, in cazul unui festival). Utilizatorii relocati vor putea opta fie pentru efectuarea unei noi relocari, in limita Biletelor disponibile, fie pentru anularea comenzii si returnarea sumelor achitate corespunzatoare comenzii anulate.

16.5. In ipoteza in care Utilizatorii, desi au achitat pretul Biletelor, nu au intrat in posesia acestora sau a altor Bilete relocate, ca urmare a epuizarii stocului Biletelor disponibile pentru evenimentul respectiv, se pot adresa Operatorului de Servicii Ticketing cu o cerere de restituire a sumelor achitate, in termen de 30 de zile de la efectuarea tranzactiei. Utilizatorii inteleg si accepta ca aceste situatii sunt datorate unor circumstante obiective neimputabile Organizatorului evenimentului sau Operatorului de Servicii Ticketing si renunta in mod expres la orice alta pretentie fata de acestia, in afara de rambursarea sumelor achitate pentru comanda anulata.

17. Protectie la supraincarcarea retelei

17.1. Operatorul de Servicii Ticketing poate limita in timp real numarul de Bilete disponibile la un anumit eveniment atunci cand cererea (globala sau locala) este foarte mare pentru a proteja reteaua / platforma de supraincarcare si a va asigura o experienta de cumparare cat mai placuta. Pe masura ce traficul scade, Biletele se vor repune in vanzare, treptat. Aceste practici sunt comune asa ca uneori s-ar putea sa observati categorii de Bilete pe cale de epuizare urmand ca in scurt timp alte Bilete sa apara la vanzare.

18. Protectia impotriva scripturilor automate de cumparare a Biletelor

18.2. Operatorul de Servicii Ticketing nu isi asuma raspunderea pentru imposibilitatea achizitionarii de Bilete de catre Utilizatorii blocati de platforma EPS din cauza asocierii acestora cu potentiali roboti sau din cauza suspiciunii folosirii de scripturi automate pentru cumpararea Biletelor. In acest sens, atragem atentia Utilizatorilor cu privire la faptul ca platforma EPS are incorporate detectoare automate de roboti / bots (sau scripturi similare de browser) care cumpara Bilete prin procedee automate sau semi-automate. Aceste detectoare pot bloca tranzactia Utilizatorilor daca observa un comportament similar, procedeul software fiind unul automat. In aceste situatii Biletele nu vor fi emise, iar tranzactia nu va fi finalizata cu succes.

19. Protectia impotriva fraudarii sistemului

19.2. Utilizatorii sunt obligati sa utilizeze Site-ul si platforma EPS cu buna-credinta, cu respectarea prezentelor Termeni si Conditii, precum si cu respectarea legii. Utilizatorii sunt obligati astfel sa se abtina de la a utiliza in mod abuziv functiile Site-ului/ platformei EPS, prin utilizarea Serviciului contrar destinatiei acestuia si contrar Termenilor si Conditiilor.

19.3. Operatorul de Servicii Ticketing isi rezerva dreptul de a anula Biletele pentru care exista suspiciunea ca au fost obtinute prin fraudarea sistemului informatic, precum si de a suspenda furnizarea Serviciilor catre utilizatorii care incalca prevederile de mai sus.

20. Locuri cu vizibilitate limitata

20.2. Anumiti Organizatori pot pune in vanzare pe Site locuri cu vizibilitatea limitata. Acestea vor avea o denumire care specifica acest lucru clar. Locurile cu vizibilitatea limitata nu garanteaza cea mai buna experienta a evenimentului. S-ar putea sa fiti nevoiti sa va ridicati in picioare pentru a urmari evenimentul sau o parte din vizibilitatea dumneavoastra sa fie afectata de balustrade sau de umbrele de baruri, corturi de sunet dar fara a se limita la acestea. Odata cumparate, aceste Bilete nu mai pot fi returnate nici inainte, nici dupa eveniment. Cumparatorul isi asuma vizibilitatea limitata in momentul cumpararii Biletelor.

21. Stergerea contului

21.2. Stergerea contului dumneavoastra de pe Site se poate realiza intr-una din urmatoarele situatii:

  • la solicitarea dumneavoastra, printr-un e-mail la adresa [email protected];
  • de catre Operatorul de Servicii Ticketing, ca urmare a incalcarii de catre dumneavoastra a dispozitiilor prezentului document;
  • de catre Operatorul de Servicii Ticketing, in caz de neutilizare de catre dumneavoastra a serviciilor Site-ului pe o perioada mai mare de 36 de luni.

22. Limitarea raspunderii

22.1. Operatorul de Servicii Ticketing nu garanteaza disponibilitatea neintrerupta si lipsita de deficiente a Biletelor prezentate pe Site si a Serviciilor.

22.2. Niciuna dintre partile contractante nu va fi raspunzatoare pentru neexecutarea obligatiilor sale contractuale (expedieri intarziate, pierderea, distrugerea, deterioarea, nelivrarea sau livrarea eronata/impartiala, sau orice alt fel de probleme), in cazul in care acestea sunt cauzate de evenimente de forta majora.

22.3. Prin forta majora se inteleg imprejurari care au aparut ca urmare a unor situatii, circumstante sau evenimente extraordinare, inevitabile, neprevazute sau orice alt act in afara controlului partilor si care este recunoscut de lege ca fiind un caz de forta majora, cum ar fi:

  • cauze naturale: seisme, cataciclisme, furtuni devastatoare, tornade, incendii naturale, inundatii, devarsari de fluvii, parasiri de albii, surpari de teren, caderi de copaci, stanci, ninsori abundente sau alte conditii meteorologice nefavorabile bunei desfasurari etc.;
  • cauze umane: starea de razboi, starea de asediu, etatizarea fortata (trecerea in proprietatea statului), revolutii, revolte, greve neautorizate etc.

22.4. Operatorul de Servicii Ticketing nu este responsabil pentru daune de orice fel pe care Cumparatorii sau oricare terta parte le poate suferi ca rezultat al indeplinirii a oricareia dintre obligatiile sale conform Comenzii si pentru daune care rezulta din utilizarea Biletelor si Serviciilor. Prin crearea si utilizarea contului, va asumati raspunderea pentru mentinerea confidentialitatii datelor de cont (user, parola, serii, numar card, dupa caz) si pentru gestionarea accesarii contului si, in masura permisa de legislatia in vigoare sunteti responsabil de activitatea derulata prin intermediul contului dvs. Crearea ori plasarea comenzilor de catre dumneavoastra reprezinta acceptul fara echivoc cu privire la Termenii si Conditiile Site-ului, precum si a platformei EPS de la data realizarii acestora.

22.5. Aveti obligatia de a utiliza Site-ul si platforma EPS cu buna-credinta, cu respectarea prezentelor Termeni si Conditii, precum si cu respectarea legii. Aveti de asemenea obligatia de a va abtine de la a utiliza in mod abuziv functiile Site-ului, prin utilizarea acestuia contrar destinatiei acestuia si contrar Termenilor si Conditiilor.

22.6. Operatorul de Servicii Ticketing nu raspunde de prejudiciile cauzate fara culpa sa, de nefunctionarea platformei EPS sau pentru cele rezultand din imposibilitatea accesarii paginilor acestuia (ex: defectiuni la reteaua de internet).

23. Relatii cu clientii

23.1. Pentru informatii sau nelamuriri legate de functionarea sau de continutul Serviciilor, va rugam sa ne contactati la adresa [email protected].

23.2. Orice reclamatii legate de functionarea sau de continutul Serviciilor pot fi transmise prin e-mail la adresa [email protected].

24. Jurisdictia / litigii

24.1. Prezentul document este guvernat de legislatia romana aflata in vigoare. Termenii si conditiile din acest document inlocuiesc alte intelegeri anterioare, scrise sau verbale, dintre partile amintite.

24.2. Orice neintelegeri aparute se vor rezolva pe cale amiabila. In cazul in care partile nu reusesc sa ajunga la un acord pe cale amiabila, dupa inregistrarea reclamatiei la sediul nostru, se va apela pentru solutionare la instantele judecatoresti romanesti competente din Bucuresti.

24.3. Inainte de a utiliza sau obtine orice materiale, informatii, Servicii prin intermediul platformei EPS, va rugam sa cititi cu atentie Termenii si Conditiile. Aceste prevederi se completeaza cu Legea nr. 365/2002 privind comertul electronic republicata si modificata si cu O.U.G. nr. 34/2014 privind drepturile consumatorilor in cadrul contractelor incheiate cu profesionistii.

25. Autoritatea in domeniu

25.1. Reclamatiile catre Autoritatea Nationala Pentru Protectia Consumatorilor se adreseaza ulterior momentului in care partile contractului au incercat solutionarea pe cale amiabila a diferendului dintre acestea.

25.2. In situatia in care nu s-a ajuns la o intelegere intre parti, Cumparatorul are dreptul de a depune o reclamatie, sesizarea putandu-se face in nume personal. Reclamatiile si sesizarile adresate Autoritatii Nationale Pentru Protectia Consumatorilor pot fi depuse doar de catre consumatori persoane fizice, fara ca divergentele dintre operatorii economici sa intre in sfera de competenta a acestei institutii.

This page presents the terms and conditions applicable to buyers of Tickets through the Event Platform Systems platform.

The terms and conditions presented below are in force starting with 23.03.2026.

The services provided through the Event Platform Systems platform are addressed only to individuals of legal age who are at least 18 years old and have full capacity to exercise, as well as to companies, regardless of their legal form. The natural person user declares and guarantees that he/she is at least 18 years old, by simply accepting this agreement. Each user declares and guarantees that, according to the applicable legal provisions, he/she has the right to use our services and access the Event Platform Systems platform and assumes full responsibility for the choice and use of our services. The age of the participants in the Events is established by the Terms and Conditions of the Organizer, the method of effective participation being the responsibility of the Organizer.

1. Defining elements

1.1. The Event Platform Systems Platform is managed and owned through the https://event-platform-systems.ro website (hereinafter referred to as the "EPS Platform") by the company EVENT PLATFORM SYSTEMS S.R.L., with registered office in Bucharest, Sector 1, Nicolae G. Caranfil Street, No. 69, 2nd Floor, unique registration code 54062665, registration no. at the J2026012420003 Trade Register, EUID: ROONRC. J2026012420003.

1.2. The Event Platform Systems is an online ticketing platform, offering users independent intermediation services in the purchase of Tickets for various events.

1.3. The Terms and Conditions represent the contract concluded by you with the Ticketing Service Operator, please read this document in full before using the services provided by our company.

1.4. In this document, the following terms shall mean:

  • "Ticketing Service Operator": EVENT PLATFORM SYSTEMS S.R.L., with registered office in Bucharest, Sector 1, 69 Nicolae G. Caranfil Street, 2nd Floor, unique registration code 54062665, registration no. at the J2026012420003 Trade Register, EUID: ROONRC. J2026012420003;
  • "Organizer": the natural or legal person acting as a professional, who offers Tickets to the events displayed on the Site to consumers, to be sold through the EPS platform, for purposes related to his commercial, business, craft or professional activity.;
  • "Site": the Organizer ' s website and the mobile applications distributed through the GooglePlay (Android version) and AppStore (iOS version) platforms, if any, from where the offer of available Tickets can be analyzed, the purchase of which will be intermediated by the Ticketing Service Operator;
  • "User": any person who accesses the Site or who uses in any way any service provided through the EPS platform;
  • "Buyer": represents the natural or legal person or other legal entity that accesses the Site and places an Order;
  • "Tickets": any Ticket to the event presented on the Site, including those mentioned in the Order or regarding the manner in which they are to be provided to the Buyer;
  • "Service": any intermediation service provided by the Ticketing Services Organizer;
  • "Order": represents the electronic document that intervenes as a form of communication between the Organizer and the Buyer, respectively between the Ticketing Service Operator and the Buyer, by which the Organizer agrees to deliver Tickets to the Buyer, respectively the Ticketing Service Operator agrees to deliver the Intermediation Services to the Buyer, and the Buyer agrees to receive these Tickets and Services and to make their payment;
  • "Contract": represents the Order confirmed by the Organizer. The conclusion of the Contract does not take place at the time of placing the Order.

1.5. By accessing and using the Site, purchasing a Ticket through the EPS platform, and/or using the Services, you fully and unconditionally agree to the provisions of this document, as well as to the Privacy Policy and the Cookie Policy, which are an integral part of it, and you undertake to check them periodically. We recommend that you read these documents carefully.

2. Changes to the Terms of Use of the Services

2.1. The Ticketing Service Operator reserves the right to modify the Terms and Conditions at any time, without prior notice or without stating the reasons.

2.2. The changes will be made by updating this document, becoming mandatory and with immediate effect.

2.3. If you do not agree with the changes made, please stop accessing and using the Services and do not purchase Tickets through the EPS platform.

2.4. Your continued access to and use of the EPS platform or the purchase of the Tickets presented on the Site or the Services by you after the modification of this document will constitute acceptance of the changes made.

3. Subject matter of these terms and conditions

3.1. This document contains the terms and conditions applicable to Ticket buyers and establishes the conditions under which any person can access the EPS platform, purchase the Tickets displayed on the Site, or use in any way the Services offered through the EPS platform.

4. Contractual documents

4.1 At the time of placing an Order, the Buyer expresses his/her consent to receive from the Ticketing Service Operator / Organizers electronic commercial messages and/or via telephone by ticking the box by declaring that he/she agrees to the transmission of the contact details to the Organizer and the Ticketing Service Operator.

4.2 Orders placed on the Site are confirmed by a registration email received after the completion of those Orders.

4.3 At the same time as the online purchase of Tickets, the Ticketing Service Operator will communicate and individualize the price related to the Intermediation Services provided separately from the price of the purchased Tickets.

4.4 After redirecting to the payment processor, Users have a maximum of 10 minutes to pay for the order, otherwise it will expire, and the selected seats can be occupied in the meantime by another User.

4.5 Following the successful completion of an Order, the Buyer receives on the e-mail address provided directly by the Organizer of the respective event either the Ordered Tickets or additional instructions necessary to be fulfilled for the claim of the Ticket. In the case of some of the events for which the purchase of Tickets is intermediated by the EPS platform, the Organizer may opt for additional steps necessary to be followed by the Buyer either to claim the Ticket or to receive access to the event.

4.6 In all cases, in order to purchase Tickets, it is necessary to accept these Terms and Conditions, the Privacy Policies, the Cookie Policy, as well as the Official Regulations of the Event sent by the Organizer.

4.7 Access to the event for which the Tickets object of the Order were purchased is based on the scanning of the QR code on the Ticket, after claiming the Ticket. QR codes are unique, the Tickets are nominal and non-transferable and each allows access to the event by a single person. a

4.8 For the final claim of the Tickets, they must be customized. Thus, the person who will be able to scan the QR code is the person mentioned on the Ticket, whose identity will be verified according to the Official Regulations of the Event. No other person will be able to scan the QR code, and once a QR code is scanned, another person cannot enter with it.

4.9 At the time of sending the Ticket to the e-mail address indicated by the Buyer, provided that the Buyer fulfills all the conditions mentioned in these Terms and Conditions, as well as in the Official Regulations of the Event, it is considered delivered and the obligation of the Ticketing Service Operator fulfilled.

4.10 For security reasons and to prevent multiple and/or fraudulent use, after delivery: (a) The Ticket may no longer be altered (including, but not limited to, the Ticket type, category, interval or session, as applicable); and (b) the QR code associated with the Ticket may not be regenerated, reissued, replaced or retransmitted in the form of a new code, for any reason, including in the event of loss, deletion, redirection, disclosure and/or unauthorized access to the User's email address.

4.11 The Buyer has the obligation to ensure the confidentiality and security of access to his own email address, to his account opened on the Site and to the device on which the Ticket is stored, as well as not to transmit the QR code to third parties. The Ticketing Service Operator shall not be liable for the unauthorized use of the Ticket as a result of compromising the User's credentials and/or disclosing the QR code to third parties, unless otherwise required by law or where the incident is caused by the sole fault of the Ticketing Service Operator.

5. Intellectual property rights

5.1 The entire content of the EPS platform is the property of the Ticketing Service Operator and is protected by copyright law, and may not be taken over, partially or fully copied or used for the creation of derivative works without the express prior written consent of the owner. Use for purposes other than personal or non-commercial is strictly prohibited.

5.2 If you believe that certain content on the EPS Site/platform infringes your intellectual property rights, right to privacy, publicity or other personal rights, please send an email to the email address [email protected] with the infringed rights, in order to allow the Organizer or the Ticketing Service Operator, as the case may be, to act accordingly for the analysis of the request and the removal of such aspect.

5.3 The use of any information on the EPS platform for purposes other than advisory, in particular for public, commercial or humorous purposes, may be subject to legal proceedings.

6. Prohibited Conduct

6.1 It is strictly forbidden:

  • partially or totally copying, disassembling, creating derivative works or using in any other way the source code of the EPS Platform, as well as any element contained in the EPS Platform Services, including, but not limited to: text, images, tables, specifications, form of presentation or content of any other nature;
  • use the EPS Platform Services for purposes other than for personal, individual and non-personal use;
  • selling, renting, distributing, transmitting, or assigning rights to a third party in the EPS Platform Services or the account created by you for your use thereof;
  • using the EPS Platform Services to invade the privacy of third parties, to obtain information about any of the users of these Services, to obtain a list of users of these Services, or to use data mining technologies, robots or other similar data collection systems;
  • copying, modifying, deleting or damaging any information contained on the technical equipment, including, but not limited to, the servers and computers used or controlled by the Ticketing Service Operator;
  • assuming a false identity or claiming a non-existent affiliation.

6.2 As a result of the violation of any prohibition provided herein, the Ticketing Service Operator has the right to block with immediate, temporary or permanent effect, the access to the account involved in the prohibited activity, without this limiting the right of the Ticketing Service Operator to resort to legal remedies to obtain compensation for any damages caused by the activity carried out through your account.

7. Rights and obligations of the contracting parties

7.1 These general conditions of sale set out the contractual conditions applicable to Tickets purchased through the EPS platform.

7.2 By accepting these provisions of the Terms and Conditions, the User and/or the Buyer agrees to the following:

  • if the User/Buyer is a natural person, acts in his/her own name and does not represent any other person;
  • if the User/Buyer is the representative of a legal entity, he/she declares that he/she acts within the limits of the power of attorney granted to him/her;
  • The buyer will provide real, accurate and complete information in order to use the EPS platform;
  • The User/Buyer shall not use the EPS platform to reproduce, duplicate, copy, sell, resell, distribute, publish or exploit, for any commercial purpose, the software, content, offers or Services provided by the Ticketing Service Operator, Organizers or partners or obtained through the EPS platform without obtaining the express, prior and written consent of the Ticketing Service Operator. This restriction includes any attempt to incorporate any information from the EPS/Site platform into any other catalog, product, or service;
  • The User/Buyer shall not use the EPS platform/Site in any way that could adversely affect the availability of its resources or its use by other Users/Buyers or in any way that could damage, disable, overload or damage the servers or networks of the Ticketing Service Operator or third parties;
  • The User/Buyer shall not use the EPS platform/Site for any purpose that is illegal or prohibited by these Terms and Conditions or other relevant policies.

7.3 The Ticketing Service Operator, based on the information obligations for distance contracts, before contracting remotely, we inform you through the Website about:

  • the identity of the company, the postal address at which the Ticketing Service Operator is established as well as the e-mail address or telephone number at which we can actually be contacted, in order to allow the User/Buyer to quickly contact the Ticketing Service Operator and communicate with it effectively and, if applicable, the postal address and identity of the professional on whose behalf he/she acts;
  • the main characteristics of the Services offered by the Ticketing Service Operator, taking into account the communication environment and the products in question;
  • the total price of the Tickets and Services with all taxes included or, exceptionally, if the price cannot reasonably be calculated in advance, the method of calculating the price and, where applicable, all additional costs of any nature or, if they cannot be reasonably calculated in advance, mentioning that these additional costs may be borne by the Purchaser, including the period of validity of the offer or prices;
  • the duration of the contract, as the case may be, or, if the contract is to be automatically extended, the conditions for termination of the contract;
  • the minimum period of validity of the obligations incumbent on the Buyer according to the contract.

8. Registration on the Site

8.1 Access to Tickets sold by Organisers and Services made available by the Ticketing Service Operator can be done online, from your personal computer or from a mobile device, such as a tablet or phone, by creating an account on the Website.

8.2 The use of the Site requires the activation of cookies for the browser used by you. The browsers recommended for accessing and using the Site are those mentioned in the Terms and Conditions of the Organizer.

8.3 To create an account you need to provide a personal email address, which will be associated with your account on the Site. The Organizer will automatically transmit this data to the Ticketing Service Operator, and through this e-mail address the communication with the representatives of the Ticketing Service Operator will be carried out.

8.4 In addition, the Organizer may establish additional steps for registration on the Site, according to its own Terms and Conditions.

8.5 By creating an account on the Site, you declare that the data provided by you through the registration form are accurate and complete, and you accept that you are responsible for the activity carried out through your account.

8.6 The account created on the Site is personal, and the use of access data or the account of another person is prohibited, either temporarily or permanently. If such data have been entered due to fault and cannot be remedied or corrected directly by you, you are obliged to immediately inform the Organizer of this aspect in order to make the appropriate rectifications, under penalty of suspension and/or temporary or permanent restriction of your account. and even access to the Site. You also undertake to immediately contact the Organizer's representatives if the security of your account has been compromised. The Ticketing Service Operator cannot act in any way on the Website, not being owned by the Ticketing Service Operator, but by the Organizer, thus being absolved of any responsibility.

8.7 By accepting these Terms and Conditions, you expressly consent to the use of the telephone number or e-mail address (e-mail), necessary for the communications to be sent by the Ticketing Service Operator. This information is transmitted to the Ticketing Service Operator by the Organizer in order to provide the Services.

8.8 By registering on the Site, you will accept both the Terms and Conditions of the Organizer and the Terms and Conditions of the Ticketing Service Operator. By selecting these options and pressing the buttons for placing the order/continuing to pay, according to the Terms and Conditions of the Organizer, you indicate that you agree to comply with the terms and conditions that you have read, understood and accepted in full.

9. Placing an Order

9.1. By accessing the Site and using the dedicated menu, you can browse through the available events and, from there, to the individual page of each event, where you will see detailed information regarding that event. We mention that the selection interface is hosted directly on the Organizer's Website.

9.2. After identifying the desired event, you will select the number of Tickets next to the preferred category, within the limit of the available seats displayed in real time through the technical Ticket management system integrated into the Site. Exact instructions on the steps for placing Orders can be found on the Organizer's Website.

9.3. Tickets will not be delivered physically, but only online. Tickets will be delivered by the Organizer. The Ticketing Service Operator manages the Orders placed, centralizes these Orders and intermediates the Ticketing Service, transmitting to the Organizer the necessary details for the delivery of the Tickets.

9.4. After paying for the Tickets, you will be redirected to a new page on the Organizer's Website where it is necessary to submit your personal data in order to personalize the purchased Tickets. Only the Buyer will be able to customize all purchased Tickets.

9.5. If the Tickets are not personalized immediately after payment of the Order, we inform you that you have a period of 7 days to customize them. Thus, the EPS platform will send you an e-mail asking you to take this step and sending you a link that you can use in this regard.

9.6. If you do not customize the Tickets within the 7-day period mentioned above, starting with the 8th day, please note that for the customization of the Tickets it will be necessary to pay a fee of 75 lei.

9.7. Following the personalization of the Tickets, they will be sent to you through the e-mail address provided by you at the time of placing the order. In order to effectively access the event, please carefully review the Official Rules of the Event.

9.8. In case you will not customize the Tickets until the moment of access to the event, please note that you will not be allowed access to the event. In this case, you will not be able to recover either the cost of the Ticket or the cost of the Service provided by the Ticketing Service Operator, the Services provided by it being performed in full, and the responsibility for customizing the Tickets lies with the Buyer and not with the Organizer or the Ticketing Service Operator. Therefore, we recommend customizing your Tickets as soon as you place your order.

10. Silver

10.1 All prices displayed on the Site are in LEI and include VAT (21% rate). The prices shown do not include delivery costs.

10.2 In accordance with the Emergency Ordinance no. 34/2014 regarding the rights of consumers within the contracts concluded with professionals, as well as for the modification and completion of some normative acts, the Ticketing Service Operator undertakes to inform the Buyer of the payment methods for the purchased Tickets.

10.3 The Buyer is aware that when placing the order for the Tickets, this order implies the obligation to pay.

10.4 The Ticketing Service Operator does not set the price of the Tickets, but only the price of the Services, and reserves the right to change the prices applicable to the Services at any time, without any prior notice and without reason.

10.5 We inform you that the Organizer also reserves the right to change the price of the Tickets, for more details please access the Terms and Conditions of the Organizer.

10.6 The new prices will be applicable only to Tickets and Services purchased after the date of the price change. If you do not agree to the price changes, you have the option to stop using the Services.

10.7 All payment issues will be fully handled by the representatives of the Ticketing Service Operator. If you have any questions, please send an e-mail to [email protected].

11. Payment methods

For the purchase of Tickets, the following payment methods will be accepted:

11.1 Card payment

11.1.1 Payments via debit or credit cards are processed by BT iPay. Communication with the payment processor is done through a secure SSL connection, the transmitted data being encrypted. All card information will be processed exclusively by the payment processor.

11.1.2 By keeping active the option "Activate the fast payment option", present in the online payment form made available to the Ticketing Service Operator by the payment processor, the user agrees to activate the service through which online payments can be made later only by entering the CVC2/CVV security code.

11.1.3 In addition to card payments, there is also the online platform operating fee for orders paid by card. The actual payment amount will be displayed before being directed to the payment processor's page.

11.2 Payment by bank transfer

11.2.1 It is necessary to make a written request to [email protected] for the transmission of bank details.

12. Billing

12.1 Each confirmed Order includes the type of Tickets and Services, prices, method and payment term.

12.2 If the customer wishes to issue the invoice related to the Order, fiscal invoices can be issued following a written request received by sending and email to [email protected].

12.3 The request must contain all complete and correct data: the order number or the name on which the order was placed and the complete billing data (name, CUI/CNP, trade nr. reg, registered office/office, bank account, bank with which the account is opened, delegate).

12.4 The invoice for the Ticket price is not issued by the Ticketing Service Operator, but by the Event Organizer on whose behalf we sell Tickets. Your request will be sent by e-mail directly to the Organizer.

12.5 If the price related to the Intermediation Services is collected from the Buyer, then the invoice for the Buyer is not issued by the Event Organizer but by the Ticketing Service Operator, the customer will thus receive two invoices: the one issued by the Organizer representing the price of the Ticket, as well as the one issued by the Ticketing Service Operator, representing the Services.

13. Right of withdrawal

13.1 The acquisition of services related to leisure activities, if a specific execution date is provided, is exempted from the application of the right of withdrawal regulated by GEO 34/2014, in accordance with art. 16 letter l) of the aforementioned normative act.

13.2 Leisure activities represent the totality of means, events and forms of leisure, meant to ensure recreation, relaxation, good mood and satisfaction.

13.3 At the same time, the contracts for the provision of services are exempted from the right of withdrawal, after the complete provision of the services, if the execution has begun with the prior express consent of the consumer and after the consumer has confirmed that he has become aware of the fact that he will lose his right to withdrawal after the complete execution of the contract by the professional, in accordance with art. 16 letter a) of GEO 34/2014.

13.4 Therefore, you will not be able to request a refund of the value of the Tickets purchased by exercising the right of withdrawal, with the exceptions provided in section 15.

13.5 Intermediation services (including ticketing), online platform operation and related services provided by the Ticketing Service Operator through the EPS platform are exempt from the right of withdrawal. The Ticket Buyer expressly agrees to the commencement of the execution of the Brokerage, Ticket Issuance and Related Services from the completion of the Order. The Ticket Buyer declares that he/she understands that by completing the order he/she will lose his/her right of withdrawal, as a result of the complete execution of the contract by the Ticketing Service Operator.

14. Purchase of Tickets through the EPS platform, integrated into the Organizer's website

14.1 The Organizers will sell Tickets directly through their Own Websites, using the Services or other technical solutions provided by the Ticketing Service Operator.

14.2 In all these cases, the User understands and accepts that (a) these Websites are outside the control of the Ticketing Service Operator and (b) the terms and conditions of use of the respective Website are equally applicable to it.

14.3 Notwithstanding the foregoing, we note that the Organizers may implement and use various tools on these Sites, including but not limited to measuring the performance of advertisements or monitoring how users interact with the Organizer's Site, in order to maximize conversions from the paid campaigns they run, but not limited to them (such as pixels, trackers, Google Analytics). The use of these tools in the Organizers' Websites is at their own risk.

15. Refund of the value of the Tickets

15.1 In case of cancellation of the order, the Ticketing Service Operator will be able to refund only the price of the Ticket, not the price of the Intermediation Services related to the purchase made (including the Ticket issuance price), the online platform operating fee and the Services related to them once the transaction is completed.

15.2 In case of cancellation of the event by the Organizer, the Organizer will be able to refund only the price of the Ticket, not the price of the Intermediation Services related to the purchase made (including the price of issuing the Ticket), the online platform operating fee and the Services related to them once the order is completed. For clarity, the Ticketing Service Operator will not refund the price and cost of the Intermediation Services related to the purchase made, including the Ticket issuance price, these being non-refundable from the perspective of the Ticketing Service Operator.

15.3 The cancellation of orders and the return of the value of the Tickets can be made, if the Organizer allows it, by sending an email to [email protected].

15.4 In case you choose to return the value of the Tickets to a bank account, please provide us with an IBAN from Romania (RO .. ) or a Paypal account. The Organiser will not refund the value of the Tickets to accounts registered with banks in other countries or to Revolut accounts.

15.5 By canceling the Tickets, all Tickets in an order will be canceled. You cannot cancel only part of the Tickets.

15.6 For most events, the Organizer is free not to allow the Ticket to be waived. The cancellation of the Ticket can be made exceptionally. The purchase of tickets for shows is exempted from the application of the right of withdrawal regulated by GEO 34/2014, in accordance with art. 16 letter l) of the normative act mentioned above.

15.7 Certain Event Organizers have chosen that, in case of cancellation of an event, to return the value of the Tickets through the Ticketing Service Operator or through another ticketing agency, after 14 calendar days from the date of the cancellation announcement. In the unfortunate event of cancellation of such an event, you will be informed by e-mail and the money will be refunded according to the policies of the Event Organizer.

15.8 For certain events on the Site, the price of the Brokerage Services (regardless of their nature) is included in the displayed price of the Ticket, but this will be explicitly specified and as an exception.

15.9 The purchased Ticket can be returned or exchanged only if the Organizer accepts and only in compliance with the conditions of this chapter, unless the respective event is canceled (no longer takes place), in which case the return of the Ticket and the refund of the amounts paid will be made according to the procedure of this chapter. Under no circumstances will refund requests received on the date of the event (or on its first day, in the case of a festival) be taken into account.

15.10 The return of the Ticket can be made within the deadlines and in compliance with the conditions below, by sending a request in this regard to the [email protected]:

15.10.1 If the refund request is made more than 14 days before the date of the event (or its first day, in the case of a festival), the Ticket Buyer receives as a result of the cancellation of the Ticket only the amount paid as the price of the Ticket (without other taxes, tariffs, costs, expenses incurred by the Buyer on the occasion of its purchase, including, but not limited to, courier rate, booking fee, intermediation costs, ticket issuance, etc.) or a voucher equivalent to this amount, which can be used to purchase Tickets to other events through the Site;

15.10.2 If the refund request is made at least 7 days (but no more than 14) before the date of the event (or the first day of the event, in the case of a festival), the Ticket Buyer receives as a result of the cancellation of the Ticket, either 70% of the amount paid as the price of the Ticket (without other taxes, rates, costs, expenses incurred by the Buyer in connection with its purchase, including, but not limited to, courier fare, booking fee, if applicable, etc.), or a voucher equivalent to this amount, which may be used for the purchase of Tickets to other events through the Site.

15.10.3 If the refund request is made at least one day before (but no later than 7) the date of the event (or its first day, in the case of a festival), the Ticket Buyer receives as a result of the cancellation of the Ticket, either 50% of the amount paid as the price of the Ticket (without other taxes, rates, costs, expenses incurred by the buyer at the time of its purchase, including, but not limited to, courier fare, booking fee, if applicable, etc.), voucher equivalent to this amount, which may be used for the purchase of Tickets to other events through the Site.

15.10.4 In all the above cases, the price of the Services provided by the Ticketing Service Operator is not refunded and is not taken into account when determining the value of the voucher. The option for voucher / money refund belongs to the Ticket buyer.

15.10.5 The options listed in point 15.10 may not be combined or combined.

15.11 In case of rescheduling of the event, the Ticket Buyer may request a refund of the value of the purchased Tickets, only if the Organizer accepts this option. The refund request must be made within a maximum of 7 days from the date of communication of the rescheduling decision, and the refund will be made by one of the methods provided in these Terms and Conditions. The price of the Intermediation Services related to the purchase made (including the Ticket issuance price), the online platform operating fee and the price of the Related Services, will not be refunded.

15.12 In the event of cancellation of an event, please send your request to [email protected] e-mail address as well as to the contact address of the Organizer of the cancelled event.

The Ticketing Service Operator will cooperate with the Event Organizer in question in order to refund the amounts paid as price for the Tickets purchased by you, but does not provide any guarantee in this regard and has no obligation to compensate the Ticket Buyer in the absence of a prior agreement with the Event Organizer.

15.13 Under no circumstances can Tickets be returned after the event has taken place.

15.14 Decisions to reschedule or cancel events, as well as choices between rescheduling or cancellation are made exclusively by the Organizers, without the involvement of the Ticketing Service Operator.

16. Relocations

16.1 If the Event Organizer allows, the Ticketing Service Operator may at any time relocate the Tickets purchased by you from the seats you have on other seats, with the prior information of the Buyer and with the transmission by e-mail of the new seats. These relocations are motivated by measures related to the production of events and can occur spontaneously even a few days or even a day before the event. The seats purchased by you can be occupied by technical equipment or butafores or can be relocated at the request of the performer. These cases are, however, very rare. In case you want to return the value of the Tickets if you have been relocated, you can request this according to Chapter 15.

16.2 The automatic relocation of the Ticket Buyer to places other than those selected may also occur during the Ticket purchase process, until the order is completed. This can be done automatically by the computer program that manages the sale of Tickets, as a result of the increased demand and the simultaneous access to the Site by a large number of users. Such a measure may be the consequence of objective circumstances, such as overloading the servers of the Ticketing Service Operator or payment processors.

16.3 The Ticketing Service Operatordoes not assume responsibility for automatic relocations generated by such exceptional situations and does not guarantee the unavailability of the selected seats for the period of time in which the User is in the process of paying for the Order.

16.4 By purchasing Tickets through the Site through the EPS platform, Users assume the risk of relocation to places other than those selected, in the situation described above. Users dissatisfied with the reallocated seats can contact the Ticketing Service Operator, within 3 days from the purchase of the Tickets, but in no case on the day of the event (or on its first day, in the case of a festival). The relocated users will be able to choose either to make a new relocation, within the limit of the available Tickets, or to cancel the order and return the amounts paid corresponding to the canceled order.

16.5 In the event that the Users, although they have paid the price of the Tickets, have not come into possession of them or other relocated Tickets, as a result of the exhaustion of the stock of Tickets available for the respective event, they may address the Ticketing Service Operator with a request for a refund of the amounts paid, within 30 days from the transaction. Users understand and accept that these situations are due to objective circumstances not attributable to the Event Organizer or the Ticketing Service Operator and expressly waive any other claim against them, apart from the refund of the amounts paid for the canceled order.

17. Network overload protection

17.1 The Ticketing Service Operator may limit in real time the number of Tickets available at a certain event when the demand (global or local) is very high in order to protect the network/platform from overloading and ensure a pleasant shopping experience. As traffic decreases, Tickets will gradually go on sale again. These practices are common so sometimes you may notice categories of Tickets running out and other Tickets will soon appear on sale.

18. Protection against automated ticket purchase scripts

18.1. The Ticketing Service Operator does not assume responsibility for the impossibility of purchasing Tickets by Users blocked by the EPS platform due to their association with potential robots or due to the suspicion of using automated scripts for the purchase of Tickets. In this regard, we draw the attention of Users to the fact that the EPS platform has built-in automatic detectors of robots / bots (or similar browser scripts) that buy Tickets through automatic or semi-automatic processes. These detectors can block the Users' transaction if they observe similar behavior, the software process being automatic. In these situations the Tickets will not be issued and the transaction will not be completed successfully.

19. System fraud protection

19.1. Users are obliged to use the Site and the EPS platform in good faith, in compliance with these Terms and Conditions, as well as in compliance with the law. Users are thus obliged to refrain from misusing the functions of the Site/EPS platform, by using the Service contrary to its intended purpose and contrary to the Terms and Conditions.

19.2. The Ticketing Service Operator reserves the right to cancel the Tickets for which there is a suspicion that they have been obtained by defrauding the information system, as well as to suspend the provision of the Services to users who violate the above provisions.

20. Places with limited visibility

20.1. Certain Organizers may offer for sale on the Site seats with limited visibility. They will have a name that clearly specifies this. Places with limited visibility do not guarantee the best experience of the event. You may have to stand up to watch the event or part of your visibility may be affected by railings or umbrellas of bars, sound tents but not limited to these. Once purchased, these Tickets cannot be returned either before or after the event. The buyer assumes limited visibility at the time of purchase of the Tickets.

21. Deleting your account

21.1. The deletion of your account from the Site can be done in one of the following situations:

  • at your request, by e-mail to [email protected];
  • by the Ticketing Service Operator, as a result of your violation of the provisions of this document;
  • by the Ticketing Service Operator, in case of non-use by you of the Website services for a period of more than 36 months.

22. Limitation of Liability

22.1 The Ticketing Service Operator does not guarantee the uninterrupted and deficiencies of the Tickets presented on the Site and the Services.

22.2 None of the contracting parties shall be liable for the failure to perform its contractual obligations (delayed shipments, loss, destruction, damage, non-delivery or erroneous/impartial delivery, or any other kind of problems), if they are caused by force majeure events.

22.3 Force majeure means circumstances that have arisen as a result of extraordinary, unavoidable, unforeseen situations, circumstances or events or any other act beyond the control of the parties and which is recognized by law as a case of force majeure, such as:

  • natural causes: earthquakes, catacycles, devastating storms, tornadoes, natural fires, floods, river overflows, riverbeds, landslides, falling trees, rocks, heavy snowfall or other weather conditions unfavorable to the proper development, etc.;
  • human causes: state of war, state of siege, forced nationalization (transfer into state ownership), revolutions, riots, unauthorized strikes, etc.

22.4 The Ticketing Service Operator is not responsible for damages of any kind that the Buyers or any third party may suffer as a result of the performance of any of its obligations under the Order and for damages resulting from the use of the Tickets and Services. By creating and using your account, you assume responsibility for maintaining the confidentiality of your account data (username, password, series, card number, as applicable) and for managing your account access and, to the extent permitted by applicable law, you are responsible for the activity carried out through your account. The creation or placement of orders by you represents the unequivocal acceptance of the Terms and Conditions of the Site, as well as of the EPS platform from the date of their creation.

22.5 You have the obligation to use the Site and the EPS platform in good faith, in compliance with these Terms and Conditions, as well as in compliance with the law. You are also obliged to refrain from misusing the functions of the Site by using it contrary to its intended purpose and contrary to the Terms and Conditions.

22.6 The Ticketing Service Operator is not responsible for damages caused through no fault of its own, by the non-functioning of the EPS platform or for those resulting from the impossibility of accessing its pages (e.g. internet network failures).

24. Jurisdiction / litigation

24.1 This document is governed by the Romanian legislation in force. The terms and conditions in this document supersede any prior written or oral agreements between the parties.

24.2 Any disagreements that arise will be resolved amicably. If the parties fail to reach an amicable agreement, after registering the complaint at our headquarters, the competent Romanian courts in Bucharest will be appealed for resolution.

24.3 Before using or obtaining any materials, information, Services through the EPS platform, please read the Terms and Conditions carefully. These provisions are supplemented by Law no. 365/2002 on electronic commerce, republished and amended and with G.E.O. no. 34/2014 on consumer rights in contracts concluded with professionals.

25. Authority in the field

25.1 Complaints to the National Authority for Consumer Protection are addressed after the moment when the parties to the contract have tried to settle the dispute amicably between them.

25.2 In the event that an agreement has not been reached between the parties, the Buyer has the right to file a complaint, the notification being made in his personal name. Complaints and notifications addressed to the National Authority for Consumer Protection can be submitted only by individual consumers, without divergences between economic operators falling within the competence of this institution.
